You accept this Privacy Policy when you sign up for, access, or use our products, services, content, features, technologies or functions offered on our website and all related sites, applications, and services (collectively “Nōwn Services”). We may amend this policy at any time by posting a revised version on our website. The revised version will be effective at the time we post it.

 

Collection of Personal Information. We collect the following types of personal information in order to provide you with the use of and access to our sites, applications, services and tools, and to help us personalize and improve your experience:

• Information we collect automatically: When you visit the Nōwn website (at www.benown.ca) or use Nōwn’s Services (such as the Nōwn app or Nōwn POS app), we collect information sent to us by your computer, mobile phone or other access device. The information sent to us includes but is not limited to the following: data about the pages you access, computer IP address, device ID or unique identifier, device type, geo-location information, computer and connection information, mobile network information, statistics on page views, traffic to and from the sites, referral URL, ad data, and standard web log data and other information. We also collect anonymous information through our use of cookies.

• Information you provide to us: We may collect and store any information you enter on the Nōwn website or you provide to us in context of using our site, applications, services, or tools.

When you visit the Nōwn website or use Nōwn’s Services, we also collect information such as your name, address, phone, email, selfie picture and other similar information you provide us.

 

The Way We Use Information. We use your personally-identifying information to provide information, products, and services that you have requested, share with the merchant you are transacting with, improve our marketing and promotional efforts, to statistically analyze Site usage, to improve our content and product offerings, and to customize our application’s content, layout, and services.

We may use your information to deliver information to you that, in some cases, is targeted to your interests, such as targeted banners, new services promotions, and new product offerings. We may ask you to provide us voluntarily with additional information regarding your personal or business interests, experience or requests, which may be used to customize our service for you.

We use your e-mail address, your mailing address, and phone number to contact you regarding administrative notices, marketing promotions, new Nōwn product offerings, and communications relevant to your use of the Nōwn Services.

We may also use or disclose information to resolve disputes, investigate problems, respond to subpoenas, court orders or legal process, or enforce our Terms of Use Agreement. We may disclose or access information whenever we believe in good faith that the law so requires or if we otherwise consider it necessary to do so to maintain service and improve our products and services.

We use your IP address to help diagnose problems with our server, to manage our Nōwn Services and to enhance our Nōwn Services based on the usage pattern data we receive.

 

Marketing. We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize Nōwn Services, content, and advertising. If you do not wish to receive marketing communications from us, simply indicate your preference by following the directions that may be provided within the communication or advertisement.

 

How We Use Cookies and Similar Technologies. When you access our website or use Lucova Services, we (including companies we work with) may place small data files on your computer or other device. These data files may be cookies, pixel tags, “Flash cookies,” or other local storage provided by your browser or associated applications (collectively “Cookies”). We use these technologies to recognize you as a customer; customize Nōwn Services, content, and advertising and measure promotional effectiveness.

You are free to decline our Cookies if your browser or browser add-on permits, unless our Cookies are required to prevent fraud or ensure the security of websites we control. However, declining our Cookies may interfere with your use of our website and Nōwn Services.

 

How We Protect and Store Personal Information. Throughout this policy, we use the term “personal information” to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been made anonymous so that it does not identify a specific user.

For the purpose of this policy, “Nown” shall be defined as any employee, contractor, volunteer, advisor, partner or client belonging to or working with or contracted with Nown at anytime in the past or present or future, or any of nown’s proprietary technologies, code, infrastructure, systems, method, procedures, plans, lists, all collectively or individually. “Customer” shall be defined as any person whom Nown has retained a record of their personal information by any means and persisted by any method, and “Information” shall be defined as such Customer’s personal information, regardless if it is marked sensitive or not. “Requestee” shall be defined as anyone, internal or external, who is authorized to use Nown’s software and make’s a request to Nown to preview or access or retrieve a copy of Customer’s Information, with such request made by any means including through our pos or directly to Nown. “Permission” shall be defined as Customer’s explicit and voluntary authorization for Requestee to act on behalf of Customer to access such Customer’s Information from Nown, subject to Requestee adhering to Nown’s policies and strictly limited to the period of time such Permission was provided and strictly limited to the activities authorized by Customer.

Notwithstanding the foregoing, at no time shall Nown provide, make available, allow, authorize, direct, facilitate Customer Information be made available to anyone, whether internal or external, by any means, whether transient or static, by any method and regardless if it is marked sensitive or not, unless Customer has provided the explicit and voluntary Permission to an authorized Requestee whom shall act on behalf of Customer to retrieve such Customer’s Information from Nown, subject to the above Requestee limitations. A Customer’s Permission may be provided to Requestee by means of voluntarily sharing their identifiable information, such as their email address or phone number, or through the form of a physical card or digitally on their mobile app presented to Nown’s pos, subject and strictly limited to such Customer’s understanding to the purpose of Requestee’s request for Permission from Customer. For further clarity, at no means shall Nown provide Customer’s Information to anyone other than Requestee and strictly where Nown can collect and maintain a record of Requestee and Customer’s Permission.
